USER AGREEMENT

1.1. This User Agreement (the “Agreement”) governs the use of the fotonapassport online service located at https://fotonapassport.ru/ (the “Service”), provided by the fotonapassport organization (the “Administration”).

1.2. By using the Service, including uploading a photo, registering, paying for services or receiving files, the User confirms that they have read and fully accept the terms of this Agreement.

1.3. If the User does not agree with the terms of this Agreement, the User must stop using the Service.

1.4. If the provisions of this Agreement differ from the Public Offer, the provisions of the Public Offer apply.

2.1. The Service provides intangible services: automated preparation of ID photos from a photo uploaded by the User and creation of digital files (JPG, a PDF print sheet, a ZIP archive) that meet the requirements of the selected document.

2.2. The result of the service is digital files. They become available in the personal account and are sent to the User’s email right after the payment is confirmed.

2.3. The Service is not a government authority, does not issue passports, visas or other documents and is not affiliated with the authorities that issue them. The decision to accept a photo is made by the authority or organization to which the User submits the documents.

2.4. Prices and plan contents are shown on the “Prices and plans” page (https://fotonapassport.ru/pricing/) and in section 5 of the Public Offer. The final amount is shown to the User before payment.

3.1. The Administration prepares the photo according to the size, background and face position requirements of the selected document known to the Service at the time of the order.

3.2. The Administration does not guarantee uninterrupted and error-free operation of the Service and is not liable for temporary technical failures, access restrictions or actions of third parties, except as expressly provided by applicable law.

3.3. The Administration is not liable for the consequences of the User using the files for purposes other than intended, or for the decisions of authorities and organizations that accept documents.

3.4. The limitations of liability in this section apply to the extent permitted by applicable law and do not limit the User’s mandatory consumer rights.

4.1. The Service is not intended to encourage, organize or facilitate any unlawful activity.

4.2. The User undertakes to upload only their own photos or photos of persons who have given their consent (for minors, photos of their own children or wards), and to use the Service in accordance with applicable law.

4.3. It is prohibited to use the Service to make counterfeit documents, to impersonate another person or for any other purpose that violates the law or the rights of third parties.

5.1. The software, design, texts and other materials of the Service are protected by intellectual property law.

5.2. The User may not copy, distribute, resell or otherwise use the materials of the Service without the permission of the right holder. The User may use the finished files with their own photo without restriction.

5.3. Infringement of intellectual property rights may result in restricted access to the Service.

6.1. The Administration may suspend or restrict the User’s access to the Service in the event of:

6.1.1. a breach of the terms of this Agreement;

6.1.2. detected abuse, including attempts to bypass payment or the limits of the Service;

6.1.3. requirements of law or of payment providers.

6.2. Restriction of access does not release the User from obligations that arose earlier and does not deprive the User of the right to a refund for services not provided.

7.1. Services are paid for on the terms shown in the Service before payment. The price and currency are shown before payment.

7.2. A refund is possible if:

7.2.1. the service was not provided or the files were not delivered due to a technical fault of the Service;

7.2.2. the photo was not accepted for the selected document because it did not meet requirements that the Service should have taken into account.

7.3. To request a refund, the User contacts support at support@fotonapassport.ru within 7 calendar days of payment. The procedure and timing of refunds are set out in section 12 of the Public Offer.

7.4. The User undertakes not to initiate a chargeback through a bank or payment system without first contacting the Service’s support.

8.1. The Administration processes the User’s personal data (email address, uploaded photos, technical data) only to the extent necessary to provide the services, in accordance with the Personal Data Processing Policy.

8.2. The Administration takes reasonable organizational and technical measures to protect the data.

9.1. The Administration may amend this Agreement.

9.2. The current version of the Agreement is published at https://fotonapassport.ru/legal/terms/ with its publication date.

9.3. Continued use of the Service after a new version is published means the User accepts the updated terms.

10.1. For any questions, including payments and refunds, the User may contact support at support@fotonapassport.ru or through support in the personal account.
